Avice Caroline Wilson, of Marrickville, claimed £400 compensation from Paisons Bros and Co Pioprietary. Ltd, for the death of her daughter, Avice Heath Wilson, a faclory worker, who suffered a fractured skull on October 2 last, through a machine breaking and a piece striking her on the head, causing her death two days later. The daughter's earnings were 38/3 per week The respondents denied liability to pay compensation under the Act on the ground that the applicant was not dependent on the earnings of deceased as allered or at all and also that the amount claimed was excessive. The Commission awarded applicant £150 compensation, holding that she and her three childi en were partial, and not total, dependents Mr M Henwood appeared for the applicant and Mr Ingham (instructed by Messrs Eric Howat d and Solomon) for the respondents. |
