A DIVORCE CASE. An action for divorce came before his Honour the Chief Justice in the Supreme Court yesterday, in which the parties were Edward Augustus Munro (plaintiff), Annie Catherine Munro (defendant), and Leslie C. B. Hillcoat (co-defendant). Mr. L. E. Groom (instructed by Messrs. Crouch and Darvall) appeared for tho petitioner. There was no appearance on behalf of the defen- dant or co-defendant. From the petition it was shown that the plaintiff and defendant were married at Holy Trinity Church, Woolloongabba, by the Rev. H. Simmons, on 28th March, 1894. They lived together some time in Brisbane after their marriage, and then went to Townsville, Longreach, Muttaburra, and Maryborough. While at Muttaburra it was alleged that the re- spondent became intimate with the co defendant, who was a drover, and mis- conduct took place with him while there in January last, also subsequently at Brisbane some time in May last. Plaintiff there- fore asked that his marriage should be dis- solved. Edward R. Crouch deposed as to the proper service of the petition. Edward, Augustus Munro, the plaintiff, stated that he was a photographer, residing at South Brisbane. He went to Muttaburra with his wife in November, 1899. There he kept a hotel, and the co-defendant, who stayed at the hotel, frequently took his (witness') wife out for a drive. She afterwards be- came cold towards witness, and in answer to a question said it was Hillcoat she cared for. She asked to be allowed to go and live with him ; but witness refused. Witness and his wife afterwards went to live at Alice, on the Central Railway. They next came to Rockhampton, and then to Brisbane, where his wife told him she had made arrangements to go and live with the co-defendant. She admitted having mis conducted herself with Hillcoat, and witness subsequently left her. Witness next saw his wife and the co-defendant at Gympie. Two other witnesses deposed to seeing defendant and Hillcoat together at an hotel in Brisbane. His Honour said he was satisfied, and gave judgment for a decree nici for the dissolution of the marriage, to be moved absolute three months from date. Costs against the co defendant. |
