NISI PRlUS.—At 10.30 a.m., before the Chief Justice—In Divorce: Amy Melville Mills v Joseph Stephenson Mills ; Agnes Caldwell Johnson v. Robert Godschall Johnson (part heard) : Leonard Raymond Wilkie v. Claire Percival Wilkie. IN CHAMBERS.— At 10.30 a.m., before Mr. Justice Draper. The West Australian (Perth) 17 May 1928 A DIVORCE POINT. "No Intention to Desert." In the Divorce Court yesterday, the Chief Justice (Sir Robert McMillan) heard an undefended petition by Agnes Caldwell Johnson, in which she sought a dissolution of her marriage with Robert Godschall Johnson on the ground of de- sertion. Mr. A. J. Chick appeared for pe- titioner. At the end of the petitioner's evidence the question of the intention of a respondent to desert a petitioner was dis- cussed. Petitioner said she was married to re- spondent at Bunbury in April, 1922 and they were happy for a year, after which respondent began to drink and lost his position at Bunbury. He was later rein- stated and was then employed at Mundi- jong. At Christmas time, 1924, she went to her home at Bunbury and respondent followed. He stayed only one day and then went to Perth and left the same day for Sydney. He did not tell her he was going. Later she received tw0 letters in which he confessed he cleared out through money troubles and asked for her moral support in his endeavour to "make good" in the East. She answered the first letter and told him to come back when he "made good," but did not reply to the second letter. She had not heard from his since February, 1925. His Honour: Where is there evidence of intention to desert? Mr. Chick: It is shown by his going away without telling his wife. His Honour: But he went away to avoid monetary troubles; not to desert his wife. He was a bad husband, I agree, but there is no evidence of his intention to end the marriage. On the contrary, he writes an appealing letter to his wife to bear with him in his troubles. The case was adjourned to Chambers for further argument.
